This position is not eligible for overtime compensation.Job TypeClassifiedDepartmentCounty AttorneyAbout the PositionThe Appeals Prosecutor I-III manages a caseload of appellate and postconviction cases that involve a variety of legal issues involving constitutional criminal procedure, substantive criminal law, sentencing law, and ineffective assistance of counsel. Appellate cases involve oral arguments at all levels of Arizona courts, and postconviction cases involve contested evidentiary hearings. An Appeals Prosecutor will also work closely with the trial bureaus to assist on complex legal issues, which includes drafting pleadings and appearing in superior court.About UsWe believe in integrity.     • Juris Doctor (JD) from an accredited and American Bar Association (ABA) approved law school
    • Must be admitted to practice law and are in good standing with the State Bar of Arizona at the time of applicationOther Requirements
      • To be considered for a Prosecutor II position, must have at least 3 years of experience as a practicing attorney, but work as a prosecutor is given full credit and most other types of experience as a practicing attorney are credited at 50%
      • To be considered for a Prosecutor III position, must have at least 8 years of experience as a practicing attorney, but work as a prosecutor is given full credit and most other types of experience as a practicing attorney are credited at 50
      • In addition to experience minimums, the nature and quality of an applicant's overall legal experience will be considered in determining whether an offer is made for a Prosecutor I, II, or III positionWe Also Value
        • An appellate clerkship, appellate litigation experience, or five years of prosecution experienceJob Contributions
          • Compose memoranda and pleadings regarding legal issues of concern as needed in assigned cases
          • Handle felony post-conviction litigation, juvenile appellate litigation, lower court appeals in Superior Court, special actions, and other litigation before the Arizona Court of Appeals, Arizona Supreme Court, and U.S. Supreme Court
          • Research and analyze legal issues using both computerized legal research and hard copy tools
          • Respond to written post-conviction motions and petitions, including Rule 32 post-conviction relief
          • Comply with all rules regulating professional responsibility, including specific rules addressing the prosecution function
          • Maintain professional relationships with victims, witnesses, law enforcement agencies, and members of the community
          • Conduct and supervise evidentiary hearings and present oral arguments as needed.
          • Discuss and present an analysis of criminal legal issues with trial attorneys, supervisors, and the County Attorney
          • Negotiate the resolution of assigned cases in compliance with Victims' Rights and cover court and other duties as assignedWorking Conditions
            • Office and courtroom setting in high-volume, fast-paced environment with frequent stressful situations
            • May require long periods of sitting while completing paperwork, standing, and moving about during the course of performing duties
            • Ability to travel to and from various county locations for court appearances, meetings, and trainings, utilizing personal or county-owned vehicle
